About Us

These Terms & Conditions ("Terms") govern your use of kimberlymadson.com (the "Site") and your purchase of products from Kimberly Madson Art & Design ("we," "us," or "our"). By using the Site or placing an order, you agree to these Terms.

Kimberly Madson Art & Design is a small business located in Tehachapi, California, selling handmade goods including decorative knobs, Cork Bellas jewelry, books, and digital products (ebooks).

Eligibility

You must be an adult under applicable law to place an order or create an account on the Site.

Customer Accounts

You may create an account to make purchases and track orders, or check out as a guest. If you create an account, you agree to provide accurate information, keep your login credentials confidential, and accept responsibility for activity that occurs under your account. Notify us promptly if you believe your account has been compromised. You may close your account at any time by contacting us. We reserve the right to suspend or delete accounts used in violation of these Terms.

Orders and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent or contain pricing or listing errors. If we cancel an order after you've been charged, we'll issue a full refund.

Payment is processed at checkout through our payment provider. Prices are listed in US dollars and do not include applicable taxes or shipping, which are calculated at checkout.

Shipping

We currently ship physical products within the United States only, via USPS or UPS. Orders typically ship within 3 to 5 business days unless otherwise stated in a specific listing or by email, and every order includes a tracking number. We are not responsible for delays caused by carriers, weather, or other events outside our control. Risk of loss passes to you upon our delivery of the product to the carrier.

Digital Products (Ebooks)

Digital products are delivered electronically. Upon purchase, you receive a personal, non-exclusive, non-transferable license to download and use the digital product for your own personal, non-commercial use. You may not resell, redistribute, share, or reproduce digital products, in whole or in part, without our written permission. Download availability may be limited in time or number of downloads; save a copy of your purchase promptly.

Because digital products are delivered immediately, all sales of digital products are final unless the file is defective, in which case we'll replace it or issue a refund.

Returns and Refunds

Our full Refund and Returns Policy forms part of these Terms. In summary:

• Returns are accepted within 30 days of purchase. Items must be unused, in original condition, and in the original packaging, with a receipt or proof of purchase.
• The following items cannot be returned: custom knob orders of 7 or more, Cork Bellas, destash items, PDF downloads and other downloadable products, clearance items, gift cards, and perishable goods.
• Sale items are not refundable; only regular-priced items may be refunded.
• Exchanges are offered only for items that arrive defective or damaged.
• You're responsible for return shipping costs, which are non-refundable. For higher-value returns, we recommend trackable shipping or shipping insurance, as we can't guarantee receipt of your returned item.
• Approved refunds are credited to your original payment method. Items marked as gifts at purchase are refunded as a gift credit to the recipient.

Handmade and One-of-a-Kind Items

Many of our products are handmade or one-of-a-kind. Minor variations in color, texture, and finish are inherent to handmade goods and are not defects. Product photos are representative; the item you receive may vary slightly.

Intellectual Property

All content on the Site — including product designs, photographs, text, logos, and the contents of our books and ebooks — is owned by Kimberly Madson Art & Design or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without written permission.

Acceptable Use

You agree not to use the Site for any unlawful purpose, to interfere with the Site's operation, to attempt unauthorized access to any part of the Site, or to submit false or misleading information.

Third-Party Links

The Site contains links to third-party websites, including our Etsy shops, Instagram, and newsletter provider. We are not responsible for the content or practices of third-party sites. Purchases made on Etsy are governed by Etsy's terms and policies.

Disclaimer of Warranties

The Site and its products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of your use of the Site or purchase of a product is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Kimberly Madson Art & Design from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Kern County, California.

General Provisions

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be reformed to the minimum extent needed to make it enforceable.

No waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Entire agreement

These Terms, together with our Privacy Policy and Refund and Returns Policy, constitute the entire agreement between you and us regarding the Site and supersede prior communications on the subject.

Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations in connection with a sale or transfer of the business.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
